Court rules four must defend themselves in ex-MP George Muchai murder case

The High Court in Nairobi has ruled that four men must answer to charges over the killing of former Kabete MP George Muchai.

Justice Kanyi Kimondo said the prosecution had brought enough evidence to show that the four could have played a role in the murder and should therefore give their side of the story.

The four are: Eric Mungera Isabwa, Raphael Kimani Gachii, Mustafa Kimani Anyoni, and Stephen Astiva Lipopo.

Mr Muchai was shot dead in February 2015 along Kenyatta Avenue in Nairobi, together with his driver Stephen Ituu Wambugu and two police bodyguards, Constable Samuel Kimathi and Constable Samuel Lekakeny.

The Director of Public Prosecutions (DPP) called 37 witnesses, including a taxi driver who was placed under protection after testifying. 

The driver linked one of the accused, Mustafa Kimani Anyoni, to the crime and handed over a gun safety pin found in his car, which police later confirmed as evidence.

Government pathologist Dr Johansen Oduor testified that all four victims were shot at close range using powerful firearms, suggesting the attack was carefully planned and not random.

Justice Kimondo said the prosecution had made a strong case and ordered the accused to prepare their defence.

 However, he did not comment on separate robbery-with-violence charges they are also facing in a different court.

Three other people who had been charged alongside them — Jane Wanjiru Kamau, Margaret Njeri Wachiuri, and Simon Wambugu Gichamba — were set free after the judge found there was not enough evidence to keep them in the case.

The four remaining suspects will now have to defend themselves when the case resumes on October 22, 2025.
