IEBC publishes by-election winners as United Opposition vows to challenge results in court

The publication comes amid growing political tension, with the opposition insisting it will not accept the outcomes in areas where it alleges intimidation.

The Independent Electoral and Boundaries Commission (IEBC) has published the winners of the November 27, 2025, by-elections, even as the United Opposition vowed to challenge some of the results in court, citing violence, intimidation and alleged interference in several constituencies.

In a special Kenya Gazette notice dated December 1, 2025, IEBC Chairperson Erastus Ethekon declared candidates elected to the Senate, National Assembly and County Assemblies after tallying and verification.

But the publication comes amid growing political tension, with the opposition insisting it will not accept the outcomes in areas where it alleges intimidation, manipulation and illegal state involvement.

Wiper leader Kalonzo Musyoka, speaking on Sunday, accused senior government officials and security agencies of meddling in the Mbeere North and Malava parliamentary by-elections.

He said the coalition had gathered what he termed “clear evidence” of interference during voting, tallying and transmission.

He announced that the United Opposition is preparing a legal petition to challenge the results.

“We will go to court. Kenyans must know that what happened in Mbeere North and Malava was not an election. It was a state operation,” Mr Musyoka said.

He alleged that some presiding officers were forced out of tallying centres, agents were blocked from observing counting, and security personnel were deployed selectively in ways that created opportunities for vote manipulation.

The Government has not responded to the allegations, but senior UDA figures have dismissed the claims as “political excuses,” insisting the party won fairly.

IEBC Chairperson Erastus Ethekon, in the Gazette notice, affirmed that all the declared winners “received the majority of the votes cast” and met constitutional and statutory requirements for election.

But the publication comes in the wake of chaotic scenes witnessed during the mini-polls, which the opposition says compromised the credibility of the outcome.

In Kasipul, violence broke out at Agoro Sare Primary School, where rival groups clashed and Homa Bay Town MP Peter Kaluma observing the election was assaulted.

His bodyguard's firearm was also reported stolen during the commotion.

In Malava, election day was marred by clashes in Butali Ward, where a vehicle linked to DAP-K  leader Eugene Wamalwa's convoy was torched.

At least two people were injured in a separate confrontation outside a hotel as tensions escalated between rival supporters.

In Mbeere North, observers recorded incidents of harassment, intimidation and attempts to interfere with activities at polling centres, raising concerns about the safety of election officials and agents.

Mr Musyoka and lawyer Ndegwa Njiru said the United Opposition will file a petition to challenge the election outcome especially in Mbeere North and Malava constituencies.

"William Ruto knows that UDA did not win in Mbeere and Malava. He employed every trick to give the impression that he won. As Wakili Njeru has said we are going to file a very strong petition," said Mr Musyoka.

He said the election was marred with corruption and that the opposition was going to indicate which Cabinet Secretaries campaigned openly contrary to the constitution.

Lawyer Njiru, who attended the function at Mukuni AIC, said there were issues including use of violence and rigging and wondered why the IEBC chairman had not spoken out against it.

He said he had received instructions from opposition leaders to file a petition on the elections which experienced such interference.

On the Mumbuni North Ward by-election, Mr Musyoka thanked the people of Mumbuni North for electing the Wiper Candidate Antony Kisoi against a spirited onslaught from government allied candidates vying on the UDA and Maendeleo Chap Chap tickets.

"Although this was an MCA seat it looked like a Parliamentary contest," said Mr Musyoka.

He thanked Machakos Governor Wavinya Ndeti and the Members of Parliament who took part in the campaigns led by Kathiani MP Robert Mbui and former Machakos Town MP Dr Victor Munyaka for leading a successful campaign.

Mr Musyoka said the Kamba community had showed that they had a firm stand and could not be easily swayed by bribes adding that he had information that the government had spent over Sh30 million in the Mumbuni North Ward campaigns.

Ms Ndeti thanked the people of Mumbuni North for not embarrassing her with a loss.

"People of Mumbuni North, you saved me from shame. I thank everybody who was involved. Our opponents hurled a lot of abuses at us, but we forgave them," said Governor Ndeti.

She assured that her government was going to work with the MCA-elect Mr Kisoi to deliver services to the people of Mumbuni North.

The thanksgiving event which was also attended by MPs and MCAs was presided over by Reverend Masaka.
