Terms of Service (ToS) for AVDelta News

Welcome to AVDelta News (the “Website”), owned and operated by AVDELTA IMPACT MEDIA LIMITED (“we,” “us,” or “our”), a company registered in Kenya. These Terms of Service (“Terms”) govern your access to and use of the Website, including all content, features, and services provided through the Website (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with these Terms, you are strictly advised not use the Services.

1. Acceptance of Terms

By using the Website, you confirm that you are at least 18 years of age or have the consent of a parent or legal guardian, and you agree to comply with these Terms. We may update these Terms from time to time by posting the revised version on the Website. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms. In case of a different minimum adult age in your country, please ensure you are on the right side of law enforcers.

2. Use of the Services

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes, subject to these Terms.

3.1 Ownership

The Website and its Content are protected under the laws of Kenya and international copyright treaties.

You may download or print limited portions of the Content for personal, non-commercial use, provided you retain all copyright and proprietary notices. No other use, including reproduction, distribution, or modification, is permitted without our prior written consent.

3.3 User-Generated Content

If You (“Content Consumer” or “Citizen journalist”), submit comments, feedback, or other materials (“User Content”) to the Website, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display such User Content in any media. You represent that you own or have the necessary rights to submit the User Content and that it does not violate any laws or third-party rights.

4. Third-Party Links and Content

The Website may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites. Your use of third-party sites is at your own risk. In case you suffer any financial or reputational loss or even actual bodily harm as a result of visiting third-party websites, you are on your own.

5.1 “As Is” Basis

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of accuracy, reliability, completeness, or fitness for a particular purpose. We do not guarantee that the Website will be uninterrupted, error-free, or free of viruses or other harmful components. Nonetheless, we strive as much as possible to ensure consumer experience is good and that the site is secure.

5.2 News Content

The Content on the Website, including features and news articles, is provided for informational purposes only. We strive to ensure accuracy, but do not warrant the accuracy, completeness, or timeliness of the Content. You should verify information independently before relying on it.

6. Limitation of Liability

Upon termination, your license to use the Services will cease, and you must stop accessing the Website. Provisions of these Terms that by their nature should survive termination (e.g., intellectual property, limitation of liability, indemnification) will remain in effect.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms or your use of the Services shall be resolved exclusively in the Kenyan courts and you consent to their jurisdiction.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

11.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without restriction.

At AVDelta News, we value and respect your data privacy.

A brief history of interest in the right to privacy takes us back to the 1960s and 1970s with the advent of information technology.

The surveillance potential of powerful computer systems prompted demands for specific rules governing the collection and handling of personal information.

The first ever documented data protection law in the world is that one enacted in the Land of Hesse in Germany in 1970. This was followed by national laws in Sweden (1973), the United States of America (1974), and France (1978).

Two crucial international instruments evolved from these laws. The Council of Europe's 1981 Convention for the Protection of Individuals with regard to the Automatic Processing of Personal Data (Convention 108), and the Organisation for Economic Cooperation and Development (OECD) Guidelines Governing the Protection of Privacy and Trans-border Data Flows of Personal Data both set out specific rules covering the handling of electronic data.

These rules describe personal information as data that are afforded protection at every step from collection to storage and dissemination. The two agreements have had profound effect on the enactment of laws around the world. The protection of personal data was guaranteed for the first time as a separate right granted to an individual in Convention 108.

After about 50 years of development of data privacy law in the world at last Africa has increasingly started to be involved in the discourse. While the uptake of data protection laws in Africa between 2000-2010 was painstakingly slow, as only 10 countries enacted comprehensive laws during that period, the situation is now fast changing. The last 10 years have witnessed 15 more countries passing their laws including Gabon(2011), Angola (2011), Ghana (2012), Lesotho (2012), South Africa(2012), Mali (2013), Cote d'Ivoire (2013), Madagascar (2014), Chad (2015), Equatorial Guinea (2016), Malawi (2016), Sao Tome and Principle (2016), Kenya (2019), Uganda (2019), and Egypt (2019). 

Domiciled in Kenya, the first point of reference is the Data Protection Act, 2019. We faithfully apply Fair Information Practice Principles (FIPP) in the collection, processing of personal data to ensure good data governance. We are focused to core data protection principles namely Notice/Awareness; Choice/Consent; Access/Participation; Integrity/Security; and Enforcement/Redress.  

We strictly borrow best practices as outlined in GDPR, a European Union privacy law that came into effect on May 25, 2018, replacing the last major piece of EU privacy law, the European Directive on Data Protection, which dates from 1995.
