President Ruto nominates Kithure Kindiki new Deputy President after Gachagua ouster

President William Ruto has nominated Interior Cabinet Secretary Kithure Kindiki as the next Deputy President of Kenya.
Prof Kindiki is slated to replace impeached Rigathi Gachagua who was axed by the National Assembly and the Senate.
Prof Kindiki is expected to become the country's second Deputy President in the current Kenya Kwanza administration.
Kirinyaga Governor Anne Waiguru, who was part of the leaders who were eyeing for the country's second-in-command seat, was first to congratulate the Cabinet Secretary for being handpicked by Dr Ruto as his Deputy.
"My brother Professor @KindikiKithure, my sincere congratulations. To you history has placed an honor and responsibility accorded to only a few. May God guide you and HE @WilliamsRuto as you lead this great country to achieve its tremendous potential," Ms Waiguru posted in her Facebook account.
"To those that supported me for this position, I thank you. We must now dedicate our efforts to building a better Kenya under the leadership of His Excellence William Samoei Ruto and His Excellence Abraham Kithure Kindiki," she continues.
However, a law suit has been mounted in court, challenging his nomination.
Lawyer Danstan Omari, in a certificate of agency, moved to the High Court on Friday arguing that Prof Kindiki's nomination was contrary to the provisions of the Constitution.
"The nomination of Prof Kithure Kindiki has been done in gross violation of Article 137 of the Constitution as he is a state officer serving as the Cabinet Secretary in charge of Interior Security," Mr Omari argued.
He also challenged the National Assembly for convening a Special Sitting to deliberate on whether to approve or reject the proposed nominee to the seat.
"On the morning of the 18th October 2024, the 1st Respondent (National Assembly) conducted a special sitting deliberating on whether or not to approve the name of Prof Kithure Kindiki the current Cabinet Secretary in Charge of Interior Security as the Deputy President of the Republic of Kenya pursuant to a nomination made by the President of the Republic of Kenya," the lawyer argued.
"That no party shall stand prejudiced if the orders sought herein are granted as there is an urgent need to return to Status Quo and in order to allow this Honourable Court to thoroughly investigate the constitutional violations cited herein including investigating whether it is possible under law for the President of the Republic of Kenya to nominate a replacement to the office of the Deputy President of the Republic of Kenya in the glaring absence of the commissioners of the Independent Electoral and Boundaries Commission (IEBC) who have the singular duty of approving such nomination under Article 82 and 88 of the Constitution of Kenya," he added.
