Milimani Chief Magistrate Lucas Onyina said he was not convinced that the car dealer was a flight risk.

City car dealer Joseph Kairo Wambui, popularly known as Khalif Kairo, has been released on a cumulative cash bail of Sh2 million after he denied charges of failing to honour car sales contracts.

In granting him bail, Milimani Chief Magistrate Lucas Onyina said he was not convinced that Kairo was a flight risk.

He faced two(2) separate charges of fraud contrary to Section 315 of the Penal Code.

For each of the charges, the court granted him a cash bail of Sh1 million with an alternative of a bond.

According to one of the charges, Kairo on diverse dates between July 10, 2024, and July 25, 2024, at Westlands by means of fraudulent tricks induced one Jeff Munane to pay him Sh2.1 million for the purchase of a motor vehicle which he never delivered.

The court heard that the money was paid to him through his company Kai & Kairo Limited.

On the second count, it is alleged that he obtained Sh2.98 million from Dora Okoth towards the purchase of a Subaru Outback, but he never delivered the motor vehicle.

This offence is said to have been committed on diverse dates between July 29, 2024 and November 16, 2024.

The Prosecution had sought to have him denied bail on the grounds that he was a flight risk.

But Onyina in his ruling said the charge facing Kairo is a misdemeanor and he is unable to see any reason why Kairo should not be granted bail.

With respect to the charge involving Sh2.9m, Onyina said.

"The accused person is released on a cash bail of Sh1 million with one contact person. His passport will be deposited with the senior court administrator and the trial shall be fast-tracked."

For the charge involving Sh2.1m Kairo was granted a cash bail of Sh1 million with an alternative of Sh1 million bond.

The court set January 28, 2025, as the pre-trial date.
