Court allows 14-day detention of Dutch national as DPP probes assault and drugs links

The Dutch national who was charged with assault and suspected drug trafficking will not be deported soon after all.

A Kwale court has allowed police to detain him for 14 days to complete investigations.

Elwin Ter Horst, 47, was arrested at Boma Banda Cottage in Diani following reports of violent conduct.

It includes assaulting his Kenyan girlfriend, Angela Atieno, spitting on a police officer, and damaging property at Diani Police Station.

Senior Assistant Director of Public Prosecutions (SADPP) Rosemary Nandi told the court that detectives were investigating multiple offences, among them assault, malicious damage to property, resisting arrest, and suspected drug-related activities.

Ms Nandi said the suspect’s continued detention was necessary to safeguard evidence and ensure justice for the victims.

She noted  that the DPP’s office was determined to uphold the rule of law regardless of nationality.

“The Office of the Director of Public Prosecutions remains committed to ensuring accountability and justice for all, irrespective of citizenship,” she said.

Senior Resident Magistrate Joy Mutimba granted the DPP’s application, directing that the suspect be held at Port Police Station until investigations are concluded.

The case will be mentioned on November 13, 2025, for an update on the progress of investigations.
