Natembeya not yet off the hook: DPP appeals High Court acquittal

Natembeya will now wait  to see if the DPP's case goes through or he can start receiving the damages costs awarded by the High Court.

The Director of Public Prosecutions (DPP) has filed an appeal after the High Court cleared Governor George Natembeya of Trans Nzoia County.

The case involves alleged misuse of public funds and conflict of interest.

High Court ruling

On March 4, 2026, Justice Bahati Mwamuye barred the DPP, the Directorate of Criminal Investigations (DCI), and the Ethics and Anti-Corruption Commission (EACC) from investigating or prosecuting the governor.

The court also awarded Natembeya Sh2.5 million in damages, with interest accruing from the date of judgment until full payment.

What Natembeya is accused of

Prosecutors said Natembeya improperly acquired over Sh3.2 million through transactions with three companies:

  • Lyma Agro Science Limited
  • Maira Stores
  • Easterly Winds Limited

These transactions took place between January 2023 and April 2025. They allegedly benefited the governor indirectly, creating a conflict of interest.

Specifically, he is accused of gaining Sh1,127,900 through Mercy Chelangat, director of Lyma Agro Science and owner of Maira Stores.

He is also alleged to have gained Sh2,124,668 from Emmanuel Wafula Masungo, owner of Easterly Winds Limited.

Both individuals had active business dealings with the Trans Nzoia County government.
