Petition seeks to halt swearing-in of possible DP Gachagua replacement

A legal petition filed in Eldoret High Court aims to block Chief Justice Martha Koome or her representatives from swearing in a new Deputy President, should the Senate confirm Deputy President Rigathi Gachagua’s impeachment.
The petition, brought forth by lawyer Morara Omoke, challenges the legitimacy of the impeachment process and has been marked as urgent.
Mr Omoke argues that DP Gachagua's removal lacks proper public participation, alleging irregularities in the collection of MPs' signatures and accusations of bribery and coercion during the process.
He also questions the impartiality of key parliamentary figures, such as National Assembly Speaker Moses Wetang'ula, who publicly supported the impeachment prior to formal deliberation.
The petition claims that Gachagua’s impeachment is politically motivated, with the Deputy President being targeted for his advocacy of reforms in the Mt Kenya region's agricultural sectors.
The petitioner also raises concerns about forged signatures, including MPs reportedly discovering their names had been added without their consent.
The court has scheduled the next hearing for October 17, 2024, where further directions will be given.
In the meantime, Mr Omoke seeks a conservatory order to prevent any actions toward swearing in a new Deputy President until all legal challenges are resolved.
Mr Gachagua is to know his fate next week before the Senate.
